As reported in, and you know details are hard to come by, the Koskoff firm gave a press conference this morning and that has been widely reported on. As reported in the Wall Street Journal, previously there was an offer to settle the case for I think $32 or $33 million. That represented the policy limit for two of the four insurance companies that were defending or responsible for defending Remington.

1:22:17 Now, all four insurance companies have tendered or offered their policy limits, and that is $73 million. Presumably, that will settle the case for the nine families involved. What I find particularly shocking about this is that it eviscerates, eliminates, erases traditional notions of proximate cause. Usually in a case involving personal injury, you have to show that the acts or omissions of the person you're suing actually caused, legally caused damage to another person. In this case, the plaintiffs are legislating by litigation.

1:22:53 They're deciding what the law should be and they're terrorizing or attempting to terrorize private industry into doing what they think is right. Now, what's the legal background here? Remington was sued under the Connecticut Unfair Trade Practice Act, which makes it possible to pursue a company if they engage in immoral or unscrupulous advertising. Because Remington marketed these devices as tools for combat and presumably targeted young men for those, and Adam Lanza had the gun, never mind that his mother bought it. She wasn't the one who was tooled for, targeted for advertising. Therefore, this represented an exception to the federal bar on suits against gun manufacturers.

1:23:38 It was an extremely close case in the Connecticut Supreme Court, decided 4-3. The U.S. Supreme Court decided not to weigh in and the result was the case could advance for trial. But here's what's highly unusual and makes you wonder kind of what's going on. Because the case involving Remington and the Sandy Hook families was set to start trial in September. There's another trial that is set to start in September, and that's the case of the Sandy Hook families versus Free Speech Systems and Alex Jones. So how are those two trials going to take place simultaneously? Well, they were- Let's be clear, the same law firm, the same Democrat law firm?

The world is a string of causation, of events linked to one another when looked back at from a certain perspective in time. But proximate cause says there has to be some limitation on causation. And usually the doctrines that reign in limitations on causation are an identifiable victim, an imminent risk of harm, where it was foreseeable that the person would be, would be harmed. Now, if Remington had had the balls to try that case and put it on in front of a jury, they could have said, look, maybe the advertising was irresponsible, but it's not proximately related to Adam Lenz's decision to go out and wipe out a classroom of first graders and the adults trying to protect them. It was a horrible event.

What do you make of the judge while the jury deliberating? Throwing out and saying they didn't have malice of forethought with intent to do harm I mean, how do we know that?

1:35:37 Well, so the judge, you know, all judges have a responsibility to prevent cases from getting to a jury unless there's sufficient evidence for a reasonable jury to find in favor of the plaintiff or the government if it's a criminal case. This judge concluded that Ms. Palin had not produced at trial sufficient evidence of malice to permit the case to go to judgment. However, the judge did something very, very significant. He basically took a reservation on that decision and he's letting the jury continue to deliberate. So that if the jury disagrees and says it did, then and the case goes up for appeal, they won't have to retry the case. So it's an unconventional move. The judge is a guy named Ned Rakoff. He's a very bright person. I've seen these sort of reservations taken before. But the larger issue is whether Ms. Palin, whether the New York Times V. Sullivan will survive.

1:36:29 and whether as to public figures, there'll be a finding of actual malice as necessary for a case to get to a jury on defamation. Now, you know, Palin, I guess got lucky that the plaintiffs didn't, you know, move for a default against her. We wanted to raise the same defense in your case. And, you know, as the case evolved, the Koskoff plaintiffs were able to create an image of what your company should look like and persuaded you because it didn't look that way. You weren't complying with discovery and she entered a disciplinary default. We disagree with that ruling and if necessary, we'll take an appeal at the appropriate moment. But, you know, the First Amendment is on the line everywhere.

1:37:13 And, you know, to protect debate, the New York Times versus Sullivan has said of public figures that you have to prove more than that a speaker got something wrong. You have to prove actual malice. Some people say that standard is too high. to have the same standard for everyone. And then over here though, the other side defaults us, we give them all our stuff, they lie and say we didn't give it to them, and then now I'm just guilty, the judge says, and then I've got to be shut down. That is extremely dangerous and that goes with everything else we're seeing where justice is one way for the left and one way for the right.

But the committee that you talk about sought you. In the Sussman case, he sought the FBI.
