How can they, and at least DC judges will do whatever they tell them, how can they pretend they had enough to arrest Brian Cole Jr.

It's the way that we found that it didn't work during the January 6th prosecutions. But there are two tiers that the DC justice system has. One of them is called the Superior Court and the other is called the District Court. The Superior Court is the lower. It's similar to like a state or a local court system. So if you got charged by your county or your sheriff or your local police officers, they would bring you in front of the equivalent of Superior Court. It's usually done in the states.

Now the crazy thing about DC is that there's one United States Attorney's Office, and that's run by Jeanine Pirro at the moment, and they can bring cases in the Superior Court, which is the lower level. That's where most of the January 6th cases should have gone, the minor trespassing, the property damage, things like this. And only serious federal crimes that the FBI is investigating normally go into the district court. So you've got the local DC Metro PD and they bring their cases, generally speaking, to Superior. And then you'd have the federal stuff goes to district. So people have to understand that to begin with. Now you have grand juries on both. You've got district grand juries and you've got Superior Court grand juries. When you go out there and charge someone, you've got two ways you can do it.

You charge them with the crime. And when you do that, then you go and you take it to the area that you did. So there's Superior Court grand juries, and there's District Court grand juries. Here's where the shenanigans just came in. Brian Cole Jr. was arrested under a complaint that was filed with the District Court, the District of DC. And they arrested a guy out of Woodbridge, Virginia for the pipe bomber case, claimed that he was the one who did it. The way that you have to do that is you have to have probable cause. Now, you can argue that in front of a judge as a complaint and the judge just basically takes your hand on a Bible or raise your hand on the phone and you swear out that you've got enough there and then they go and they go and get the arrest warrant. But then you've got to go in front of a hearing later, which is called a preliminary hearing, where if you don't take it to the grand jury,

That's why they see you can always indict a ham sandwich because you only present what you want when you're going to a grand jury. If you don't get that indictment, then you have to take it in front of a judge for a preliminary hearing. So not only were they going to decide whether or not they keep him locked up, they were also going to have to decide whether or not they even had, they being the DOJ, met the burden of proof for probable cause, which is the lowest level in the system. In order to arrest somebody, it just has to be more likely than not that they were the one who did the thing that you allege. And then you have to take it in front of a jury, you try the case, you give them all the evidence, and you have to meet the highest bar, which is as it should be. It's supposed to be beyond a reasonable doubt. No reasonable person could believe that they didn't do the crime.

We want to wait until we get in front of a grand jury. We don't want to have a preliminary hearing and the defense which is really aggressive. It's a new law firm that's out of Tennessee. They're former United States attorneys and they're apparently very good. Went out and said no, no, no. We insist on having the preliminary hearing today, Tuesday, December the 30th.
